MANILA, Philippines (PNA) -- Supreme Court (SC) Spokesman and Court Administrator Atty. Jose Midas Marquez on Monday said that there is no stopping the execution of warrant of arrest against Dinagat Islands Rep. Ruben Ecleo because the SC has not issued a Temporary Restraining Order (TRO) on the Sandiganbayan order. The leadership of the House of Representatives had previously said that once they obtain copies and a certification of finality, they will strike out Ecleo from their rolls.
The anti-graft court on Monday made final and executory the graft conviction of Ecleo, dismissing his motion to recall the Sandiganbayan resolution and a warrant for his arrest.
In a resolution, the Sandiganbayan said that Ecleo himself had noted that the Supreme Court had ruled on the different petitions he filed before the court. Hence, the anti-graft court said, the decision is now final and executory.
The Sandiganbayan earlier affirmed three graft convictions against Ecleo in connection with his stint as a mayor of a town in Surigao del Norte between 1991-1994.
A separate parricide case remains pending against Ecleo in connection with the death of his wife, 4th year medical student Alona-Bacolod Ecleo, who died on Jan. 5, 2002.
Ecleo won as representative of the lone district of Dinagat Islands in the May 10, 2010 synchronized national and local elections.
